These Terms of Service ("Terms") govern your access to and use of the website theformful.com (the "Website") and any services, products, or content offered by Raivo Ernstreits, trading as Formful ("Formful", "we", "us", or "our"). By accessing the Website or purchasing our services, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
1. About Us
Formful is a digital media production and game development business operated by Raivo Ernstreits, self-employed person (saimnieciskās darbības veicējs), registered in the Republic of Latvia. Contact: contact@theformful.com.
2. Services
Formful provides digital media production, game development, film, animation, and interactive entertainment services and digital products. Specific terms for individual projects or commissions will be agreed in writing before work commences and form part of these Terms.
3. Eligibility
You must be at least 18 years of age to purchase services or products from us. By placing an order, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
4. Orders and Payments
4.1 Placing an Order
When you place an order through the Website, you are making an offer to purchase. We reserve the right to accept or decline any order. An order is confirmed only when you receive a written confirmation from us or a payment receipt.
4.2 Pricing
All prices are displayed in the currency indicated on the Website and are inclusive of applicable taxes unless stated otherwise. We reserve the right to change prices at any time. The price applicable to your order is the price displayed at the time of checkout.
4.3 Payment Processing
Payments are processed by Stripe, Inc. By submitting payment, you agree to Stripe's Terms of Service. We do not store your full card details. Payment must be received in full before delivery of digital products or commencement of commissioned work, unless otherwise agreed in writing.
4.4 Right of Withdrawal and Refunds
Consumers in the European Union have the right to withdraw from a purchase within 14 days without giving a reason.
— Physical products (TAKE NOTE 3D Premium): the 14 days start on the day you receive the product. To withdraw, email contact@theformful.com with your order details, or use the withdrawal form below. Return the product within 14 days of telling us. You pay the cost of returning it. We refund the full payment, including standard delivery cost, within 14 days of your notice; we may wait until the product is back with us. The product must be returned complete and undamaged.
— Digital products (downloads): the download starts immediately after payment. At checkout you are asked to agree to this and to confirm that you lose your right of withdrawal once the download is available. Without that agreement, the purchase cannot be completed. This confirmation is included in your order email.
— Defective products: if a product is defective or does not match its description, contact us and we will repair, replace or refund it, as required by law.
— Business customers: the right of withdrawal applies to consumers only.
— Custom commissioned work: refunds are governed by the individual project agreement.

5. Intellectual Property
5.1 Our Content
All content on the Website, including but not limited to text, graphics, images, videos, logos, software, and code, is the intellectual property of Raivo Ernstreits / Formful or its licensors and is protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
5.2 Commissioned Work
Ownership of intellectual property for custom commissioned work will be defined in the individual project agreement. Unless explicitly transferred in writing, Formful retains all intellectual property rights in work created, granting the client a licence appropriate to the agreed scope.
5.3 Digital Products
Upon purchase of a digital product, you are granted a non-exclusive, non-transferable, personal licence to use the product for the purpose described in the product listing. You may not resell, sublicense, or redistribute digital products without explicit written permission.
6. Prohibited Use
You agree not to use the Website or our services to:
— Violate any applicable law or regulation
— Infringe the intellectual property rights of any party
— Transmit harmful, offensive, or fraudulent content
— Attempt to gain unauthorised access to our systems
— Engage in any activity that disrupts or interferes with the Website
— Use automated means (bots, scrapers) to access the Website without our consent
7. Disclaimers
The Website and its content are provided on an "as is" and "as available" basis without any warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or free of viruses.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Formful and Raivo Ernstreits shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Website or our services, even if advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the Website shall not exceed the amount paid by you to us in the 12 months preceding the claim.
